Terms and Conditions of Carriage

These Terms and Conditions govern the transport services provided by megdog.co.uk (the "Company") for the movement of vehicles, watercraft, towed units, and commercial freight. By booking a service with the Company, the customer (the "Client") agrees to be legally bound by these terms.

1. Definitions and Parties

• Company: Refers to megdog.co.uk and its authorized sub-contractors or agents.

• Client: The individual, business, or entity booking the transport service.

• Goods: Cars, boats, caravans, trailers, and commercial goods to be moved.

• Consignor/Consignee: The parties handing over or receiving the Goods.

2. Quotations, Booking, and Route Fees

• Validity: All quotes are valid for 30 days from the date of issue.

• Basis: Quotes are based on information provided by the Client.

• Trailer Options: Quotes specify transit via either an open vehicle trailer or an enclosed vehicle trailer.

• Premium Options: Enclosed trailers offer enhanced protection and are subject to higher premium pricing.

• Adjustments: The Company reserves the right to alter the price if the dimensions, weight, or condition of the Goods differ from the booking description.

• Deposits: A non-refundable booking deposit may be required to secure a transit slot.

• Route Surcharges: All road tolls, Congestion Charges, and Clean Air / ULEZ zone fees incurred during transit are the sole responsibility of megdog.co.uk and are included within the quoted rate.

3. Pre-Loading Inspection, Verification, and Condition Reports

• Photographic Record: Prior to loading, the Company will take comprehensive photographs documenting the exterior and interior condition of the vehicle.

• Communication Channel: These photographs will be sent immediately to the Client via WhatsApp or SMS messaging.

• Client Verification & Loading Authorization: The Company will not load the vehicle onto the trailer until the Client has reviewed the photos and explicitly replied via WhatsApp or SMS to confirm that it is their vehicle and that they authorize loading.

• Delays in Approval: Any delay by the Client in reviewing and approving the photographs while the transport vehicle is on-site will count directly toward the standard allocation of free waiting time at collection.

• Mechanical Exclusions: The Company conducts visual inspections for cosmetic/structural damage only. The Company does not inspect, test, or accept liability for any pre-existing or underlying mechanical, electrical, or structural component issues. These remain the sole responsibility of the Client.

4. Specific Transport Requirements

• Cars / Vehicles: Must be free of hazardous personal items. The Client must declare if the vehicle is non-running, lacks brakes, or has steering issues.

• Boats / Watercraft: Must be securely lashed to a roadworthy trailer or pre-cradled. Loose items inside the boat must be safely stowed below deck.

• Caravans / Towed Units: The Client guarantees that the chassis, hitch, tyres, and braking systems are fully roadworthy for towed transit.

• Commercial Goods: Must be packaged, palletized, or securely bundled by the Client to withstand normal transit movements.

5. Client Obligations, Waiting Times, and Document Handling

• Access: The Client must provide safe, legal, and suitable access for large transport vehicles at both collection and delivery points.

• Waiting Time: The first 60 minutes of waiting time for loading (including photo verification delays) or unloading is free. Thereafter, waiting time will be billed at £125 per hour, or part thereof.

• Keys and Documents: All vehicle/vessel keys and documents will be placed into a sealed holder at collection. They will only be unsealed and handed directly to the designated receiver upon delivery.

6. Insurance and Liability

• Standard Coverage: The Company maintains valid Public Liability and Goods in Transit (GIT) insurance up to £50,000 per consignment.

• Specialist Items: For high-value or specialist cargo exceeding £50,000, coverage can be increased. This must be requested by the Client and confirmed in writing prior to collection. Additional insurance premiums will apply.

• Limitations: Liability is restricted to structural damage caused directly by Company negligence during transit.

• Exclusions: The Company is not liable for mechanical or electrical failure, stone chips (on open trailers), weather damage, or damage caused by pre-existing rust or wear.

7. Delays and Force Majeure

• Schedules: Estimated collection and delivery times are guidelines only.

• Exemptions: The Company is not liable for delays caused by weather, traffic congestion, road closures, ferry cancellations, mechanical breakdowns, or industrial action.

8. Standard and Ferry Cancellation Terms

• Standard Notice: Cancellations made less than 48 hours before the scheduled collection will incur a cancellation fee equal to 50% of the total booking value.

• Same-Day Notice: Cancellations made on the day of transport will be billed at 100% of the quoted rate.

• Ferry Bookings: If a route requires a ferry crossing and a booking has already been purchased, the Client is liable for 100% of the non-refundable ferry ticket costs in the event of a cancellation or amendment, regardless of how much notice is given.

9. Payment Terms and Storage Fees

• Timing: Full payment is strictly due via bank transfer upon delivery of the Goods.

• Clearing: Goods will not be offloaded or released until the bank transfer has fully cleared into the Company’s account.

• Lien: The Company reserves a general lien on all Goods for monies due.

• Storage Accrual: If delivery cannot be completed due to non-payment or delayed bank transfer, storage charges will accumulate at a rate of £1,000 per day.

• Upper Limit Valuation: The upper cap for accumulated storage charges is strictly limited to the estimated trade auction value of the vehicle or asset. This value will be determined by an independent trade guide or trade auction platform (e.g., CAP/HPI or BCA data) reflecting the asset's condition at the time of collection.

10. Claims and Complaints

• Inspection: Goods must be inspected by the Consignee immediately upon delivery.

• Reporting: Any damage or discrepancies must be noted on the delivery note and reported in writing to the Company within 24 hours of delivery.

11. Governing Law

• Jurisdiction: These terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the English courts.
